By creating an account, logging in, purchasing SMS credits, or using any AUXANOSMS service, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

3. Eligibility

You must be:

  • At least 18 years old

  • Legally capable of entering a binding contract

  • Using the service for lawful purposes only

We reserve the right to refuse service to any user at our discretion.

4. User Responsibilities

You agree not to use AUXANOSMS for:

  • Sending unsolicited messages (spam)

  • Fraudulent, abusive, or deceptive activities

  • Threats, harassment, or hate speech

  • Promotion of illegal goods, scams, or harmful content

  • Messaging without recipient consent

  • Violating NCC regulations or applicable laws

You are responsible for:

  • Maintaining the confidentiality of your login details

  • Ensuring your sender ID, message content, and campaign comply with legal standards

  • The accuracy of phone numbers and message content

5. Sender IDs

  • All sender IDs must be approved before use.

  • We reserve the right to reject sender IDs that are misleading, illegal, or violate messaging guidelines.

  • Regulatory bodies may override or block certain sender IDs based on compliance rules.

6. Message Delivery

AUXANOSMS strives for high delivery rates, but we do not guarantee:

  • 100% delivery to all networks

  • Delivery timeframes

  • Delivery to numbers that are invalid, DND-enabled, switched off, blacklisted, or out of coverage

We are not liable for delivery failures caused by:

  • Network providers

  • Regulatory restrictions

  • User errors

  • Internet downtime

7. SMS Credit Usage

  • All SMS purchases are final once credits are delivered to your account.

  • SMS credits are non-transferable and non-refundable, except in cases of proven system errors.

  • Credits may expire if required by regulatory or system limitations (optional: add expiry if applicable).

8. API Usage

If you use our API:

  • You are responsible for the security of your API key.

  • Abuse of the API may result in suspension without notice.

  • We are not liable for financial or data loss resulting from misuse of your API key.

9. Prohibited Content

You may not send messages related to:

  • Fraud, phishing, scams

  • Pornography or adult content

  • Violence, threats, or hate speech

  • Illegal drugs or weapons

  • Unapproved political messaging

  • Mobile network bypass or SIM-boxing

Violation may result in account suspension or legal action.

10. Payments & Billing

  • Payments must be made through approved channels.

  • Prices may change without notice.

  • Chargebacks or fraudulent payment reversals may result in account termination.

11. Refund Policy

Refunds are only granted when:

  • SMS credits were purchased but not delivered to your account

  • Duplicate payments are confirmed

  • Services were not provided due to verified technical failure on our end

Refunds do not apply for:

  • Already-used SMS credits

  • Failed deliveries caused by networks or user errors

  • Suspended accounts due to policy violations

12. Privacy & Data Protection

We value your privacy. AUXANOSMS will:

  • Not sell or share your personal data with unauthorized parties

  • Use your data only to provide and improve services

  • Comply with applicable data protection laws

You agree not to misuse or attempt to access data that does not belong to you.

13. Account Suspension & Termination

We may suspend or terminate your account if:

  • You violate these Terms

  • You send prohibited or illegal content

  • You engage in fraudulent activities

  • Regulatory bodies request action

Suspended accounts may be reviewed upon request.

14. Limitation of Liability

AUXANOSMS is not liable for:

  • Loss of profits, income, data, customers, or reputation

  • Delays or failures caused by network providers or third-party systems

  • User mistakes such as wrong numbers or message content

Our total liability shall not exceed the value of the user’s most recent SMS purchase.

15. Service Modification

We reserve the right to:

  • Add, modify, or remove features

  • Change pricing

  • Update these Terms

Continued use of the service indicates acceptance of such updates.

16. Governing Law

These Terms and Conditions are governed by the laws of the Federal Republic of Nigeria and applicable telecommunications regulations.
